1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website, facilities, services, memberships, classes, products, and communications offered by RDA Academy (“RDA Academy,” “we,” “our,” or “us”). By accessing our website, registering for classes, enrolling in memberships, purchasing products or services, or otherwise interacting with RDA Academy, you agree to be legally bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services

RDA Academy offers martial arts instruction and related services, including but not limited to:

-Brazilian Jiu-Jitsu

-Muay Thai

-Kickboxing

-Self-Defense

-Children’s martial arts programs

-Introductory and trial classes

-Membership-based training

-Private instruction

-Seminars and events

-Retail merchandise and training equipment

-Online scheduling and account management

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Eligibility

You must be at least eighteen (18) years of age to enter into membership agreements independently. Participants under eighteen (18) may enroll only through a parent or legal guardian. By registering a minor, you represent that you have the legal authority to do so.

4. Assumption of Risk

Martial arts and fitness activities involve inherent risks that cannot be completely eliminated.

These risks include, but are not limited to:

-Cuts and bruises

-Sprains and strains

-Joint injuries

-Broken bones

-Concussions

-Permanent disability

-Death

By participating in any activity offered by RDA Academy, you voluntarily assume all risks associated with participation, whether known or unknown.

5. Release of Liability

To the fullest extent permitted by law, you release and hold harmless RDA Academy, its owners, instructors, employees, contractors, volunteers, affiliates, successors, and assigns from any claims arising out of or related to your participation in academy activities.

Nothing in these Terms limits any rights that cannot legally be waived under applicable law.

6. Medical Responsibility

You acknowledge that:

-You are responsible for determining whether you are physically capable of participating.

-You should consult a physician before beginning any physical activity if appropriate.

-You will immediately inform instructors of any injury, illness, or medical condition that could affect participation.

-Participation is entirely voluntary and at your own risk.

7. Memberships, Billing, and Payments

Membership Fees

Membership fees are due according to your membership agreement. Recurring memberships authorize RDA Academy to automatically charge your designated payment method on the agreed billing schedule.

Failed Payments

If a payment cannot be processed, we may:

-Retry the payment

-Suspend membership privileges

-Restrict access to classes

-Charge any applicable late fees where permitted by law

Price Changes

Membership pricing may change. Existing members will receive any legally required notice before changes become effective.

Refund Policy

Unless otherwise required by law or stated in writing:

-Membership fees are non-refundable.

-Retail purchases are final except for defective merchandise.

-Missed classes do not create credits or refunds.

8. Trial Programs and Promotional Offers

Free trials, introductory offers, guest passes, and promotional pricing are offered at our discretion.

These offers:

-May be limited to first-time students

-May not be combined

-May be modified or discontinued without notice

9. Suspension or Termination

RDA Academy reserves the right to suspend or terminate memberships immediately for reasons including:

-Unsafe conduct

-Harassment

-Threatening behavior

-Repeated violation of academy rules

-Damage to academy property

-Failure to pay membership fees

Termination for these reasons does not entitle the member to a refund.

10. Code of Conduct

All members and guests agree to:

-Treat instructors, staff, students, and visitors respectfully.

-Follow all safety instructions.

-Maintain proper hygiene.

-Wear appropriate training attire.

-Refrain from abusive, threatening, or disruptive conduct.

Failure to follow academy policies may result in removal from classes or termination of membership.

11. Retail Purchases

All merchandise is sold subject to availability. Prices may change without notice. RDA Academy is not responsible for injuries resulting from misuse of purchased equipment.

12. Website Use

You agree not to:

-Violate applicable laws

-Attempt unauthorized access to our systems

-Disrupt website functionality

-Introduce malicious software

-Misuse website content

We reserve the right to restrict access for violations.

13. Intellectual Property

All website content, including but not limited to:

-Logos

-Trademarks

-Branding

-Videos

-Images

-Graphics

-Written materials

Training content is owned by RDA Academy or used under license and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or commercially used without prior written permission.

14. Communications

By voluntarily providing your contact information and checking the optional box(es) (for non-marketing & marketing text message communication) on any of our contact forms, you consent to receive communications from RDA Academy regarding your account, membership, classes, purchases, customer service, and other information related to our services.

Communications may occur by:

-Email

-Telephone

-SMS (text messaging)

-Postal mail

Marketing communications are sent only where permitted by applicable law and based on your consent where required.

15. SMS Messaging Terms

By submitting your mobile phone number and checking the applicable consent box, you expressly consent to receive recurring automated and non-automated SMS messages from RDA Academy.
